Copyright & DMCA Policy

Palm Delivery Innovations QOZB, LLC, doing business as Kashew (“Kashew,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects users of our marketplace to do the same. In accordance with the Digital Millennium Copyright Act (“DMCA”) and other applicable law, we will respond to valid notices of copyright infringement and may remove or disable access to content that infringes the copyright or other intellectual property rights of others.

Reporting Copyright Infringement

If you believe that content on Kashew infringes your copyright (or the copyright of someone you represent), please send a written DMCA takedown notice to our designated agent. Your notice must include the following:

1. Identification of the copyrighted work you believe is infringed (or a representative list if multiple works).
2. Identification of the material that you claim is infringing, with enough detail (e.g., URL, listing ID, or description) so we can locate it.
3. Your contact information: full name, mailing address, telephone number, and email address.

5. A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
6. Your physical or electronic signature.

We may forward the notice (including your contact information) to the user who posted the content and/or share it with third parties as needed to process the notice. Submitting a false or misleading notice may result in liability for damages, including costs and attorneys’ fees.

Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may send a counter-notification to our designated agent. It must include:

1. Identification of the material that was removed or disabled and the location (e.g., URL) where it appeared before removal.
2. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
3. Your name, address, telephone number, and email address.
4. A statement that you consent to the jurisdiction of the federal court in your district (or in Travis County, Texas if outside the United States), and that you will accept service of process from the person who provided the original DMCA notice or their agent.
5. Your physical or electronic signature.

If we receive a valid counter-notification, we may forward it to the party who submitted the original notice. We may restore the content if the original claimant does not file a court action seeking a court order against you within a period specified by law. Submitting a false counter-notification may result in liability for damages.

Repeat Infringement

In appropriate circumstances, we will terminate the accounts of users who are repeat infringers of intellectual property rights.

Trademarks and Other Intellectual Property

We will review and respond in accordance with our policies and applicable law.
